By Mandating Condoms in Porn, California's Prop 60 Could Overturn the Industry

In the 25-plus years Brittany Andrews has been doing porn, she has never made a single film without condoms. Still, she sometimes gets surprised reactions on set.

"This guy completely freaked out on me because I used the company credit card to buy condoms," she says of one director not familiar with her brand. After a tirade on set, he checked with the film's producers, then came back with an apology.

"He said, 'Sorry about that—I've never seen anybody ever use a condom.'"

Proposition 60, a California state ballot measure to clarify existing laws mandating condom use on adult film sets, aims to change that; in doing so, it could have deep ramifications for the porn industry (which is heavily concentrated in California). But first, it has to pass in this Tuesday's election—a likely fate the porn industry is working hard to prevent.

When workers are exposed to unsafe working conditions it is the responsibility of the state to ensure those working conditions are reasonably safe. Construction workers are required to wear a helmet on the job sight. Road workers are required to wear brightly colored shirts when working in the field. Expecting male porn performers to wear condemns is not unreasonable, and it improves their safety and the safety of their sex partners. Don't want to wear a condemn? Don't make your living as a pornographic performer.

This isn't government regulation of private sex acts conducted in the privacy of your own home. This is the government regulation of a money making industry that involves sexual performance art. It's no different from requiring an actor wear a safety harness if they're going to be flying around on stage or that a high wire circus act use a net.

Saying "apples and oranges" doesn't make it true. Sexual performance art involves a certain amount of risk. Of that there can be no dispute. Requiring that this risk be minimized for the health and safety of the performers is a perfectly reasonable use of government.

Motorcycle riders didn't like it when they were first required to wear helmets, but a hell of a lot of riders are alive today because they were.
