California Sheriffs Are Openly Protesting Their New “Sanctuary State” California’s sheriffs are calling on the GOP-controlled Congress to intervene and pass a federal law to change the state’s sanctuary state status, warning the law that ties their hands too tightly will only increase the chances of another high-profile tragedy. The sanctuary state law, which Gov. Jerry Brown (D.) signed Thursday but doesn’t go into effect until January, is the most far-reaching of its kind in the country and places sharp limits on how local law enforcement agencies can communicate with federal immigration authorities. It would also make it a crime to enforce federal immigration laws on the premises of all schools, hospitals, libraries, and courthouses in state, which is home to an estimated two million immigrants. Hassling people who look like they might be Mexican is good for the sheriff business. Lots of budget increases, new military equipment etc. and all for fun roundups at the shopping center with no risk involved. Going after the drug cartels? That's a different matter. Those guys have guns and they shoot. |

Cooperation is not needed. ICE needs to get really aggressive and there is nothing leftist Brown and his traitor Democrats can do about it. |

That ^^^ is an interesting idea. Allowing states to legitimize illegals here because ICE can't do its job properly would be fair and a big help to states' rights. "If you want 'em, you can have 'em" Could save the taxpayers billions. |

The question maybe rely more on whether or not California State law contradicts Federal law and if no contradicting Federal law exists what would stop Federal government from trumping state law? The law that applies to situations where state and federal laws disagree is called the supremacy clause, which is part of article VI of the Constitution. The supremacy clause contains what’s known as the doctrine of per-exemption, which says that the federal government wins in the case of conflicting legislation. Basically, if a federal and state law contradict, then when you’re in the state you can follow the state law, but the feds can decide to stop you. When there is a conflict between a state law and federal law, federal laws prevails. |

Some people don't know the legal problems with local law enforcement operating outside ^^^ their purview. The ICE agents are empowered by federal statutes to enforce federal immigration laws. The local donut squad does not have any such authorization and they cannot be authorized by federal statute. There are some very fundamental principles of states' rights here. Local cops can, and do, pick up specific people for whom ICE has obtained a warrant. Simply stopping a guy on the street because he "looks Mexican" isn't legal and arresting him on suspicion of violation of federal immigration law would be a major legal hassle if the charges didn't stick. We're talking big bucks in court judgement. And then there is the problem of having local cops feared and hated in immigrant neighborhoods. So much for local policing etc. Immigration is a federal responsibility. Don't try and drag the local cops into the mess when local government doesn't want to get involved. |

I'm having a hard time understanding why some here can't grasp the simple jurisdictional areas of operation with a city, county, State and a Federal Office. Immigration enforcement is not, under any circumstances the purview of the local police, county sheriff, or State Highway Patrol. Number one, they're not a paid employee of the Federal Government, Number two, there isn't a budget that would'nt bust trying to assist ICE in the identification, and rounding up and detainment of illegal aliens. But..tell you what, I am all in for increasing ICE's budget for ramping up the number of agents, lawyers, and staff necessary to do what Trump and others here want. But the price is the 60 billion Trump kept stating he wants to go the DoD during his campaign and right afterward. 60 billion should be able to get more then enough of the budget. |

Tsalagi1 is a thoughtful conservative who looks a little like a peaxxxx*** in the chicken yard of today's Trump believers. Old fashioned ideas like states' rights and the rule of law go right out the window when our alt-right brethren get the wind up over some issue having to do with non-WASP people. They have been told that all their problems stem from Mexicans, blacks, Native Americans and the other "pet hamsters" who have taken their jobs, gobbled up their tax payments and flooded America with violent crime, drugs and illegitimate children. They believe all that crap because it comforts them and justifies their emotional bigotry. This is how conservatism slides into fascism. Stir up mob hate and trample down all those boundaries and distinctions in the law that conservatives hold dear and tend with loving care. "My mind is made up, don't confuse me with facts!" is the battle-cry of the alt-right. Any State that rebels against the federal government is subject to invasion by federal military force, Imprisonment or hanging of that State's political leaders, and martial law until good order can be restored...Aiding and abetting invaders is treason...........

1. there is no issue of rebellion, the issue is local law enforcement's role in enforcing federal law 2. there is no statutory penalty for rebellion against the federal government 3. in the only rebellion so far imprisonment and hanging of Confederate leaders were not used 4. illegal immigrants do not fit the definition of invaders, they are not armed and do not comit an act of war So many false statements in a single post is truly worth of fake news, or maybe it is just dumb lies, hard to tell the difference after a Thanksgiving Day dinner. |
