DOJ: Trump SoHo hotel exit 'undermines' emoluments lawsuit; He's guilty but you don't have standing

Justice Department lawyers representing President Trump say the Trump Organization's decision to walk away from its Trump SoHo hotel supports the argument for dismissing a lawsuit alleging the president is in violation of the Emoluments Clause of the Constitution.

In a letter to U.S. District Judge George Daniels in Manhattan, N.Y., on Friday, the Justice Department said that the exit from the SoHo location "undermines" a lawsuit from competing hotels and restaurants and watchdog groups arguing that Trump's business empire, including his hotels, amount to an illegal receipt of money from foreign governments, Reuters reported.

“This development undermines the hospitality plaintiffs’ reliance on alleged competition with the Trump SoHo to demonstrate standing,” the letter reportedly reads.

Trump Incorporated LLC is losing business all over the world, many properties are in the red, due largely to public apprehension to the corrupt administration. Trump's new DC hotel at the Old Post office is meeting expectations - but that's because its filled lobbyist seeking favor with the Trump administration. Trump Tower will likely be renamed next year because residents wish to distance themselves from all things Trump.

Having the Trump brand on a commercial property is now significantly reducing the properties value - just like it reduced the value of the presidency. Afterall, what would one expect from a carnival barker turned president?

Trump's investment in most of these properties consists only in the sale of his name...Walking away is very easy...........

It may or may not be easy for him to walk away from property endorsements. But regardless, its still effecting Trump's bottom line - which also symbolizes the fact people are fed-up with him.

The SoHo suit is a tricky one. The charge is a violation of a clause in the Constitution concerning gifts, profits or other benefits from foreign sources. The Trump defense has been two-fold. First, he has denied that the plaintiffs have standing to bring suit, second, he has transferred his ownership in the hotel in question to his son.

The court has granted the plaintiffs standing, agreeing that they have been torted by unfair presidential competition. The transfer of the property is after-the-fact and may be construed as consciousness of guilt.

But here's the interesting part: the President may be found to have violated the Emolument Clause whether or not the plaintiffs can demonstrate damages. Such a finding by the district court would become evidence which would make congressional trial of impeachment a virtual necessity and conviction rather likely. Ouch!

I must confess I have never tried to count the number hairs on your azz ^^^ despite the frequent occasions on which you wiggle it about here on P.com. However, one judge is sufficient for one trial, one trial is sufficient for one conviction (of the Trump Organization, not the Orange Julius himself) and one conviction could be sufficient for a bill of impeachment. You do the math and stop worrying about your fuzzy little posterior.

Trump can't be convicted by one stink'n judge while he is President...Perhaps you should pray for divine intervention to remove Trump from office...However, some say you can't petition the Lord with prayer................

Does the phrase "corporate veil" mean anything to you? You really don't seem to have the legal fundamentals needed to discuss this thread. Is that why you keep reverting to your potty mouth?

Quite so ^^^ and thank you for the courtesy of your reply. The point in this case is that the corporation retains legal liability for the damages (tort) suffered by competing hotel corporations even though Mr. Trump, as President, is immune from civil suits or criminal prosecution.

If, however, the court finds for the plaintiffs, the evidence could be used by Congress in a bill of impeachment alleging violation of the Emoluments Clause.

Trump hotel bookings have plummeted nearly 60% since the first half of 2016, it's rather easy to track hotel bookings nowadays. Hotel bookings for Trump hotels have dropped 59% compared to last year.

Lots of links say nearly the exact same thing - his only profitable property is likey the Old Post Office in DC, which is now considered the jewel of the Trump empire - simply because it's about 1.3 million in the black - and a heaven for lobbyists.

Trump draining the swamp by selling $500 dollar a night hotel rooms to lobbyists.

What one time in history ^^^ was that? The Justice Department has interpreted the clause recently, but that is not a court decision. In 2009, the question arose whether President Barack Obama could keep his Nobel Peace Prize, the Justice Department advised that there was no emoluments violation because the committee that awards the prize isn’t a “King, Prince, or foreign State." In 1963, President John F. Kennedy declined an offer of honorary Irish citizenship on the advice of the Justice Department.
