Brazil judge blocks Lula appointment to government

A Brazilian judge has blocked the appointment of ex-President Luiz Inacio Lula da Silva as chief of staff to his successor, Dilma Rousseff, shortly after he was sworn in.
The judge's injunction said there was a risk a federal investigation could be derailed if Lula was a minister.
In Brazil, cabinet members can only be investigated by the Supreme Court, not by federal courts.
Lula is under investigation in connection with a corruption scandal.
The government has appealed against the decision.

There is a brief, momentary time-out, ...as we move from Brasil to Switzerland to honor Lara Gut!

Today Lara Gut WON the overall world championship in skiing! Got the glass globe and everything. Won it all. A few weeks back Lindsey Vonn had to back away from racing again this season because of a knee injury. Gut and Vonn were tied at the time. Vonn and Gut do NOT like one another. They traded nasty tweets a few weeks ago, especially when Vonn was forced to retire. Vonn, however, did show-up in St. Moritz this week to collect her "Downhill Globe," but I suspect she was there more as an intimidating factor to Gut than anything else. Oh my, having these two women in the same room at the same time simply invites a cat fight.

But, anyway, raise your wine glass to Lara Gut tonight, the reigning world champion in skiing. Bravo Lara...!

What's going on in his corruption trial anyway, money laundering and fraud wasn't it? Any news on that?

The return to public office of Lula, who stepped down in 2010 after eight years in power as one of the world's most popular leaders, was slammed by critics as a desperate attempt to shore up support for Rousseff as she faces impeachment proceedings in Congress.

Rousseff's popularity has been pummeled by Brazil's worst economic downturn since the Great Depression and the spreading corruption investigation focused on state-run oil company Petrobras.

More than a million people marched in demonstrations across Brazil on Sunday, calling for her ouster and voicing support for the investigations into kickbacks by contractors to political leaders in exchange for work with Petrobras.

Plans to announce Lula`s appointment were overtaken by the publication of damaging new allegations from a Workers' Party senator in plea bargain testimony made public by the Supreme Court on Tuesday.

The testimony by Senator Delcídio do Amaral, a close ally of the president until he was arrested last year, accused both Rousseff and Lula of being aware of corruption at Petroleo Brasileiro SA and said the president had tried to hamper the investigation.

In the most damaging allegations, Amaral said Aloísio Mercadante, a Workers' Party veteran who has served as Rousseff's chief-of-staff and is now education minister, offered to pay him to keep quiet last year.

The news came as the team of investigators in the probe on Tuesday uncovered systematic corruption at Odebrecht, with an office to pay bribes on work for World Cup soccer stadiums and Olympics legacy projects. Raids carried out at dawn uncovered a parallel bribery scheme that helped extract money from state-controlled oil producer Petróleo Brasileiro SA, or Petrobras PETR4.SA..

Several top executives and politicians have already been imprisoned in the case, which could help topple President Dilma Rousseff, who is facing impeachment proceedings for an unrelated matter involving alleged illegal mismanagement of the budget.



Furthermore, the grandson of the founder of Odebrecht, a supporter of Lula and Rouseff, is now headed to jail for bribery.

Prosecutors said Marcelo Bahia Odebrecht, the company's former chief executive officer and scion of the namesake family that controls the firm, had continued to run the scheme after his June arrest. He was sentenced to 19 years in prison this month after being convicted of corruption and money laundering.

An engineer with a degree in finance, Odebrecht turned the conglomerate into Brazil's largest employer and one of the top-five private-sector groups. He is a staunch backer of Lula and Rousseff and lauded their efforts to help local groups grow globally.

According to Veja magazine's Radar column, Marcelo Bahia Odebrecht had already begun to testify before Car Wash prosecutors launched Tuesday's raids.

One of four siblings, Marcelo presided over a golden era for the group since succeeding his father Emilio in late 2008. Grupo Odebrecht, which now spans 15 divisions spread across two dozen countries, is choosing to cooperate with the probe to help preserve the jobs of more than 130,000 employees, its statement said.

Grupo Odebrecht, founded by Marcelo's grandfather in the mid-1940s, was involved in building or refurbishing at least four of Brazil's 12 World Cup stadiums, including the 1 billion-real ($278 million) Arena Corinthians, which hosted the opening match and will also host Olympic soccer games.

In February 2015, month before protests began, Rouseff's approval rating dropped 19 points to 23% with 44% disapproving of her in Datafolha polls. Following the 15 March protests, Rouseff's approval rating fell even further to only 13% with a 62% disapproval rating, one of the highest disapproval ratings in the past 20 years of any president. Other polls by Datafolha performed on 9 and 10 April showed that 63% believed President Rousseff "should face impeachment proceedings" while less than 15% knew that the vice president, Michel Temer, would become president if Rousseff was impeached.

In CNT/MDA polls performed in March 2015, 10.8% of Brazilians approved of Rouseff's government and 59.7 wanted her impeached. In July 2015, the CNT/MDA showed a lower approval rating of 7.7% and 62.8% of Brazilians wanting her impeachment.

On 15 March 2016, in a testimony by the former leader of Rousseff's Workers' Party, he stated that Lula da Silva and Rousseff had been trying to block investigation while also alleging that Aécio Neves may have been involved. The next day on 16 March 2016, Rousseff appointed Lula da Silva as her chief of staff in what "was widely seen as an attempt to protect him from the investigation because ministers and lawmakers can only be tried by Brazil’s Supreme Court". Later that day, a leaked phone call of Rousseff and Lula da Silva caused public outrage with Rousseff calling Lula da Silva's "terms of office" a "necessity", with prosecutors stating that this wire tap of Lula da Silva among others showed his attempts to impede investigations

The phone call between Rousseff and Lula da Silva went as follows:

Lula da Silva: Tell me, my dear.

Rousseff: It’s this, I am sending Messias round with the papers, so that we have them, just in case of necessity, that is the terms of office, right?

Rousseff: That’s all, wait there, he is heading there.

Lula da Silva: OK, I’m here. I’ll wait.

Rousseff: Right?

Lula da Silva: OK.

Rousseff: Bye.
Lula da Silva: Bye, my dear.

Lula, a former union leader and two-time president, is being investigated for his alleged role in a multibillion-dollar scheme in which kickbacks and bribes were paid on fat contracts at the state-run oil company, Petrobras. His appointment as Rousseff’s chief of staff was widely seen here as an attempt to protect him legally, because cabinet ministers and lawmakers can be investigated only by Brazil’s Supreme Court.

What is fascinating here is that Brasil will be the host to the Olympics in 4 months. Stop and ponder that. This could all turn out to be a mega disaster. They spent all of that transitory oil money on new stadiums and such but, like Greece, will have difficulty paying for it all AFTER the games. The corruption must have been massive. Brasil will once again be pushed back to third world status. Poverty and crime. Whatever happened to those BRICS...? Perhaps those socialists do-gooders (Lula/Dilma) didn't have this economic thing figured-out? Spread the wealth. Everyone will prosper, dontchaknow. Brasil, like Venezuela, is an economic catastrophe. They are dropping like flies all over South America.
