Target viral video raises question: What does it take to get arrested?

A routine visit to Target turned into a viral video that has led dozens of women to come forward with troubling stories about the same man.

A video showing Candace Spivey of Jacksonville, Florida, chasing the man has been viewed more than 2 million times on Facebook in the past week. It drew comments from other women in the greater Jacksonville area who said the same man approached them with the same story:
He's buying a maxi dress for his wife.
He wonders if it's too sheer.
Should she wear panties with the dress?
Are you wearing panties?
Response to the video prompted the Nassau County, Florida, Sheriff's Office to put out a call on Facebook identifying the man as Jeffery Polizzi. The department asked people to come forward if he had approached them with "indecent questions."
Amid the long conversation, some questions came up: How could a man get away with allegedly harassing so many women? When does creepy behavior cross the line into criminal?

I posted a topic about this when I ran into it on social media before it became a news story. This guy is the type of person who is the problem with opening up all restrooms to anyone. Even with his obvious pattern of behavior which could be considered very wrong the police don't know if they have anything to charge him with. He is smart enough not to do things that cross into illegal.

Right now, if this scumbag (or someone like him) went into a women's room in Florida he could get tossed out on his ear by the people who run his store. On the other hand, if he were in a place like Charlotte where they passed an ordinance which stated anyone could use any bathroom they chose at any time based on their own personal standard for what they feel like today, then he could not be thrown out of the women's room.

Well, he could be thrown out but then the store who tossed him would be open to a law suit that they might lose or have to settle.

I am sure that he plans on shopping in Target stores anywhere he goes now that they have their lenient policy. So, keep an eye out for scum like him.

This guy has been a perv all along. It wasn't illegal for him to go into women's bathrooms, but that was his chosen approach. Why do you suddenly think this will change?

Before, he could be thrown out of the women's room and could even be banned from the store based on store policy that the women's room is for females only. With ordinances like the one in Charlotte or policies like the one Target has chosen he can now happily enter the women's room with out any fear of repercussions. Indeed, an ordinance like the one in Charlotte would give him the power to extort money from any store that tried to throw him out for being in the women's room.

Incidentally, he probably would not choose to enter the women's room in Yulee, FL because if he did he would probably get his ass kicked or worse.

You clearly don't know what a transsexual is and why this guy would still get thrown out or arrested.

This guy is scum, but it has nothing to do with opening the restrooms to people that are living their lives in "the other" sex.

To get arrested, the first steps are taken for this guy. Identify him as a predator.
Then follow due process.

He can still be thrown out of the women's bathroom because he obviously doesn't identify as the female gender.

Legally, based on the Charlotte ordinance, he could not be thrown out.

I know exactly what a transsexual is and I have never had a problem with them using the bathroom that they appear to be after gender reassignment surgery. Heck, even if they just look like a girl or a guy I would not say anything to them for which bathroom they choose. The problem arises when a place like Charlotte passes a very loosely worded ordinance that permits anyone to use any bathroom based on person whim.

Or in the case of Target where a company says anyone can use any bathroom they choose.

As things are, based on Target's policy, this guy can go into the women's room at any of their stores without any repercussions.

How do you know that? Where in Target's policy does it define how to tell if someone "identifies as female"?

Target policy and badly worded ordinances aside, this guy is obviously a perv who is working himself up to something. Hopefully thanks to a citizen filming him doing his nonsense he can be stopped before he actually harms someone for real.
