I'm for making only laws that are needed, and can be enforced without undue cost or inconvenience to others . If there hasn't been a problem, why mess with things? The bathroom bill is symbolic, not pragmatic - government overreach. |

The North Carolina law was a response to a Charlotte ordinance. The ordinance was written badly and essentially permitted anyone, who happened to be feeling like a woman at the moment, to use the women's room. That ordinance was intended to help transgender people but the thing is, the folks who have had gender reassignment surgery were already using the bathroom that they appear to be and nobody had a problem with it. So the ordinance sought to create a legal right where none was needed. The State responded to the badly written ordinance with a badly written law using a standard that is too restrictive. By using the standard of "gender at time of birth" the State probably went too far and wrote a law that is difficult to enforce when it come to true transgender people. So, where the ordinance was bad in that it opened the door for perverts to legally enter women's rooms without any worry of being tossed out on their ear by the folks who run the facility, the state law used a bad standard that can't be effectively enforced. Sadly it is a case of two completely unneeded laws, one at the city level and one at the state level. Edited by Demagogue, May 10 2016, 10:24 AM.

What defines a "true transgender" is a topic within itself. Many self identified trans individuals will never under-go sexual reassignment surgery but will increase their hormone levels and get breast implants in the case of female trans, or increase testosterone levels, and get breast removal in the case of male trans individuals. |

That is the question isn't it. I think for myself and just about any reasonable person, once you get to the point that you are doing hormones and cutting parts out of yourself (or adding them to yourself) then at that point you will start to appear visually to be the gender you are switching to. Once you have gone that far IMHO then you use that restroom. On the other hand, if you look like a dude in drag or one of the Redskin's "Hogettes" ![]() Then you belong in the men's room. The law will probably be forced to define that now. Previously we could have just let common sense rule but after the Charlotte ordinance and then the NC law we probably can't go back to the way it was. The law will have to come up with a better definition than "Gender on birth certificate" otherwise people are going to get sued for simply trying to do the right thing. That's my take as well. Laws based on symbolism are a stupid waste of resources. We need laws to protect people from legit dangers or oppression, not to make some group feel better about themselves, or to reassure one demographic that doesn't like another. if no one was being harmed, neither law was needed. |
