A military judge decided on Tuesday to delay Bergdahl’s trial from August until February to provide time for resolving disputes over the defense team’s access to classified documents. Bergdahl, 30, sat attentively in his dress blue formal uniform, his infantry cord looped under the epaulet on his right shoulder, during the brief hearing. The soldier from Hailey, Idaho, faces charges of desertion and misbehavior before the enemy. The latter charge is relatively rare and carries the potential sentence of life in prison. A February start would mean the court martial could make headlines only weeks after the new commander-in-chief is sworn in as president. Given the shape of the campaign so far, that will probably mean either Hillary Clinton or Donald Trump will be in charge of the military. Bergdahl’s defense says the presumptive Republican presidential nominee has already damaged his chances for a fair trial by calling him a “dirty, rotten traitor” who “should have been executed”. |

The real reason for the delay... Hillary Clinton misled Congress on Bowe Bergdahl swap When Republican members of Congress learned in November 2011 that the Obama administration was contemplating a swap — Taliban terrorists for captured ArmySgt. Bowe Bergdahl — they wrote to then-Secretary of State Hillary Clinton of their fears. Mrs. Clinton wrote back that they had nothing to worry about. The White House would follow the law requiring a 30-day heads-up. “I want to make clear that any transfer from Guantanamo will be undertaken after consultation with Congress and pursuant to all legal requirements for transfers, including those spelled out in the FY2012 [National] Defense Authorization Act,” she said of the law signed by President Obama that December requiring that he notify Congress ahead of time. Fewer than three years later, Mr. Obama freed five hard-line Taliban commanders from the prison at Guantanamo Bay. As the five left Cuba, U.S. specials forces troops rendezvoused with the Taliban on May 31, 2014, at a remote location in Afghanistan to pick up Sgt. Bergdahl. The Army would later charge him with desertion. Bowe Bergdahl’s lawyers want charges dropped after ‘meddling’ by John McCain http://www.rawstory.com/2016/08/bowe-bergdahls-lawyers-want-charges-dropped-after-meddling-by-john-mccain/ Defense attorneys argued in a motion filed on Monday that comments made by McCain and the committee’s general counsel, Steve Barney, have unduly influenced his case. The filing quotes McCain as saying last October: “If it comes out that (Bergdahl has no punishment, we’re going to have a hearing in the Senate Armed Services Committee.” “I am not prejudging, OK, but it is well known that in the searches for Bergdahl, after – we know now – he deserted, there are allegations that some American soldiers were killed or wounded, or at the very least put their lives in danger, searching for what is clearly a deserter,” McCain added. The statements, among others, defense attorneys argued, undermine the independence of the military proceeding and violate Bergdahl’s rights to due process. The motion said if the charges are not dropped and Bergdahl is convicted, he should at least face no punishment. “It is not rocket science to see what was wrong with Sen. McCain’s comment,” the motion says. “His comments – as the Army certainly knows – constituted impermissible meddling in a pending criminal case and an abuse of his authority as chairman of a powerful Senate committee.” Representatives for McCain’s office could not be immediately reached for comment, nor could a spokesman for the Senate Armed Services Committee. |
