The districts policy does not mandate an automatic suspension. The incident precariously falls under the school's discretionary discipline policy, meaning the principal was not required to suspend the girl. When I say precarious I mean that disciplinary discretion is applied to "firearm facsimile that could reasonably be mistaken for an actual firearm"

The bubble gun can hardly be described as a firearm facsimile, much less one that could 'reasonably be mistaken for an actual firearm.

This is clearly a case of a principal going overboard on discipline. At most, and if any action should have been taken, the toy should have been taken from the girl til the end of the day and the parents contacted to request that they be more careful about what winds up in her back-pack.

The girl's mother admitted not knowing it was in her pack and has been quite apologetic for overlooking the toy. Although possible, It's unlikely to the point of absurdity that the girl's mother has some nefarious agenda in the works.
